Vietnam VAT Complete Guide: Rates, Filing & Compliance
Vietnam is a major destination for Southeast Asian manufacturing relocation and a popular choice for overseas enterprises. Understanding Vietnam's Value Added Tax (VAT) system is fundamental for compliant operations. This article comprehensively explains Vietnam's VAT rate structure, filing requirements, invoice management, and common compliance pitfalls.
1. Overview of Vietnam VAT: Three-Tier Rate System
Vietnam's Value Added Tax Law, implemented in 1999 and revised multiple times, has formed the current three-tier rate system. VAT is Vietnam's most important indirect tax, and almost all sales of goods and services are subject to VAT.
Standard Rate (10%): Applies to most goods and services, including electronics, clothing, household goods, catering services, etc. This is the most common rate.
Preferential Rate (5%): Applies to certain livelihood-related goods and services, including: clean water, unprocessed food, education services, medical services, agricultural inputs, etc.
Zero Rate (0%): Applies to exported goods and services, international transportation services, and goods/services provided to diplomatic agencies. The zero rate means enterprises can apply for a refund of input VAT.
Exempt Items: Certain goods and services are completely exempt from VAT, including: land transfer, financial services, insurance services, medical services (non-commercial), education services (public), etc. Note: Exemption is different from the zero rate; input VAT for exempt items is not deductible.
2. VAT Calculation Methods: Credit Method vs. Direct Method
Vietnam has two VAT calculation methods:
Credit Method: Applicable to enterprises with annual revenue exceeding VND 1 billion (approximately USD 40,000), or general taxpayers who voluntarily choose this method. Calculation formula: VAT payable = Output VAT - Input VAT. This is the method used by most enterprises.
Direct Method: Applicable to small-scale taxpayers with annual revenue below VND 1 billion, or specific industries (such as gold, silver, and gemstone trading). Calculation formula: VAT payable = Sales amount × Tax rate (usually 1-3%).
For overseas enterprises, it is usually necessary to register as a general taxpayer and adopt the credit method. This requires enterprises to establish a sound accounting system and accurately record every input and output VAT transaction.
3. VAT Filing Periods and Procedures
Filing Period: Monthly filing (for large enterprises) or quarterly filing (for small enterprises). Newly registered enterprises usually need to file monthly.
Filing Deadline: Monthly filing is due by the 20th of the following month; quarterly filing is due within 30 days after the end of the quarter.
Filing Content: Includes output VAT details, input VAT details, input VAT deduction status, VAT payable or refundable amounts, etc.
Filing Method: Online filing through the electronic tax system of the General Department of Taxation (GDT). Enterprises need to first register a digital certificate to obtain electronic signature authority.
Annual Filing: Complete the annual VAT settlement for the previous year by March 31 each year, with any overpayment refunded or underpayment supplemented.
4. Invoice Management: The Core of VAT Compliance
Vietnam has very strict management of VAT invoices, and invoices are the only valid proof for input VAT deduction. Enterprises must pay attention to:
- E-invoices: Since 2022, Vietnam has mandated e-invoices, and all enterprises must use an e-invoice system certified by the tax authority
- Invoice Elements: Invoices must include: seller information, buyer information, goods/services description, quantity, unit price, amount, tax rate, tax amount, invoice number, issue date, etc.
- Input Invoice Verification: Enterprises need to verify the authenticity of input invoices in the tax system; only verified invoices can be deducted
- Invoice Retention: E-invoices need to be retained for 10 years, and paper invoices (if any) also need to be retained
PinCloud's global ERP system is integrated with Vietnam's e-invoice system, automatically generating compliant e-invoices and verifying input invoices to ensure VAT compliance.
5. VAT Refund: A Benefit for Export Enterprises
For export enterprises, Vietnam provides a VAT refund policy, which is an important cash flow support:
- Refund Conditions: Exported goods are subject to 0% VAT; the enterprise has uncredited input VAT balance
- Refund Ratio: Usually the input VAT corresponding to export business can be refunded
- Refund Cycle: Generally 3-6 months after the refund application, but in practice it may take longer
- Refund Materials: Export customs declaration, export invoice, input VAT invoice, bank receipt proof, etc.
The refund process is complex and time-consuming. It is recommended that enterprises hire professional tax agents to assist, or use PinCloud's automated refund filing function.
6. Common Compliance Traps and Avoidance Tips
In Vietnam VAT compliance, enterprises often make the following mistakes:
- Delayed Invoice Verification: Input invoices not verified within 6 months will lose deduction eligibility. It is recommended to verify invoices regularly every month
- Incorrect Rate Application: Applying the 10% rate to goods subject to 5%, or vice versa. It is recommended to establish a goods tax rate database
- Unreasonable Related-Party Pricing: Vietnam's tax authority strictly reviews transfer pricing for related-party transactions, and contemporaneous documentation needs to be prepared
- Unreported Cash Transactions: Vietnam still has a large volume of cash transactions, and enterprises need to ensure all income is truthfully declared
- Late Filing: Late filing will result in penalties (0.03% of tax payable per day) and late payment interest
